Dilapidation Negotiations

Have you as a Tenant been served with a substantial schedule of dilapidations and are unsure whether to carry out all or some of the works, fight the schedule or try and agree a reduced amount? All of these options are possible but which is the most cost effective for you? We can advise you and negotiate on your behalf utilising our extensive knowledge not only of dilapidations but also of the related valuation techniques which also apply to such negotiations.

Are you a Landlord who has had a schedule of dilapidations prepared but are getting no response from the Tenant? What do you do next and how can you bring pressure to bear without actually issuing Proceedings? We can assist and negotiate on your behalf to ensure that all possible action is taken and then if litigation cannot be avoided we will ensure that you are in compliance with the Pre Action Protocol and in the best possible position to proceed forwards.

Terry Davis gained extensive experience preparing schedules of dilapidations and negotiating with Tenants during the period that he was practising as a Chartered Building Surveyor. More recently he has practised as a Chartered Valuation Surveyor and has dealt with a number of Diminution Valuations on behalf of both Landlords and Tenants but retains the ability to cover both building surveying and valuation aspects at the same time. On this basis he is instructed at the present time on a number of high value dilapidation claims acting for both Landlord and Tenant clients.

Terry has just completed the 2011 RICS Dilapidation Road Shows alongside Emma Humphries, of Charles Russell Solicitors, at Southampton, Bristol, Manchester, Leeds, Peterborough and London where he utilised his dual experience to talk about both building surveying and valuation matters appertaining to dilapidations.

We can carry out work on a flexible fee basis to suit our Clients’ needs and our obligations under the Civil Procedure Rules.
